A majority of Americans believe a business should not be able to refuse service to LGBT community

Christian persecution,The conservative Christian base of the Republican Party clearly wants to have a fight over what it calls “Religious Freedom” in the upcoming election cycle.  No longer able to defend their flawed logic on why same sex couples will destroy the institution of marriage they’ve moved on claiming their 1st Amendment rights are being infringed.

I’m not going to address that equally flawed logic in this post, but I am going to share that I was happy to see the results of last Thursday’s Reuters/Ispsos poll, which found that a majority (54%) of Americans believe businesses should not be allowed to refuse services based on their religious beliefs.  I believe this trumped up issue of “religious freedom” is going to be repeatedly used by conservative Christians to shape the Republican primary in an attempt to dupe the public into thinking the community that is being discriminated against (the LGBT community) is somehow at fault.

Why “religious freedom” is code for discriminating against the LGBT community

Religious FreedomEarlier this week I wrote a post, Why the “Religious Freedom” discussion is both disingenuous and dangerous.  Considering the fact that those most obsessed with the need to protect “religious freedom” are also some of our country’s most homophobic political leaders should make you think. Couple that with the fact that the discussion is a reaction to marriage equality laws and one need not be Sherlock Holmes to read these clues.

This latest debate on ‘religious freedom’ is nothing more than an escape clause for homophobic business owners to refuse service to the LGBT community.  If Christian business owners were really concerned (for their immortal soul) about having to serve people who violated their religious convictions then why are they serving customers who are divorced, practice a different religion, known adulterers or liars (and the list continues)?  Why is it that only the LGBT community that seems to be causing this crises of conscious?  It is because they are bigots using religion as a shield to disguise and and confuse the debate.

ReligionDid you know that divorce is identified as a sin approximately two dozen times in the Bible? By contrast homosexuality is discussed less than ten times so why is divorce not considered twice the sin of homosexuality? These devout Christians should be focused on all the divorcées in their community who have made a mockery of “traditional marriage”, which they supposedly hold so dear.

The Bible is riddled with all sorts of “sins” like getting your hair cut, eating shellfish, getting a tattoo, etc… yet these behaviors don’t seem to offend the supposedly ‘devout’ Christian business owners. It seems to me if religious freedom is being called into question then only business owners who truly observe every tenant of their faith should be allowed to claim this need for an exemption.  For all those who are picking and choosing their religious convictions, it sounds more like an excuse to get the government to approve discrimination – and that is unconstitutional.

Why the “Religious Freedom” discussion is both disingenuous and dangerous

What do the above phrases have in common with each other?  They are all catch-phrases employed by Republicans looking to redefine social discourse.  In the 1970s Nixon often referred to the “Moral Majority” to appeal to white, Protestant voters since racially divisive language was no longer acceptable. Two decades later “Family Values” was often cited as a way for Christian Conservatives to deflect criticism for insisting upon the need to legislate their religious beliefs.

Religious FreedomLet’s be clear the reason every conservative is suddenly claiming the Federal Religious Freedom Restoration Act (RFRA) doesn’t go far enough to protect “Religious Freedom” is more of this same bullshit.  Conservatives recognize that just as using racially charged language is no longer acceptable it is no longer acceptable to use homophobic slurs so they’ve modified their language to drum up outrage and portray themselves as victims.

When you hear someone talking about “religious freedom” stop and engage them immediately.  Don’t wave it off or ignore this language, because it is code for discrimination but presented in more palatable messaging. American’s believe in religious freedom just as much as individual liberties and the LGBT community must push back and ask what exactly about serving our community infringes upon their religious freedom?

Religious freedomWe know that silence creates a vacuum and in that vacuum this conservative messaging will thrive. Ask intelligent questions and start a dialog with anyone you hear talking about how their religious freedoms are being infringed. There is a similar parallel to the lack of substance behind the anti-marriage equality argument – but absent your dialog – Americans will come to accept and believe religious rights are being compromised and need to be protected; at the expense of your rights.

Moderate Republicans support Indiana’s “religious freedom” law

LGBT RightsI know I’ve been hammering away at this Indiana law but the responses from the supposedly moderate Republicans contemplating a run for President of the US I find as sickening as Governor Pence response to America’s reaction to the law.

The Hugh Hewitt Show:  “I think if they actually got briefed on the law, they wouldn’t be blasting this law,” Bush said. “I think Governor Pence has done the right thing. Florida has a law like this. Bill Clinton signed a law like this at the federal level. This is simply allowing people of faith space to be able to express their beliefs. I think once the facts are established, people aren’t going to see this as discriminatory at all.”

Gov. Scott Walker – Monday, March 30, 2015
FOX:  Governor Walker has been uncharacteristically quiet preferring to have spokespeople speak for him which makes me think he probably disagrees with the law but refuses to speak out against it.  Rather he had spokeswoman AshLee Strong issue the following statement, “As a matter of principle, Gov. Walker believes in broad religious freedom and the right for Americans to exercise their religion and act on their conscience.”  I have no idea what he is saying and I think that is intentional.

USA Today:  Fiorina said it was “shameful” how, in her view, liberals have fanned the furor over the Indiana law. I honestly believe this is a set of liberal political activists who practice a game of identity politics and divisive politics to whip people into a frenzy, and I think it’s very destructive to the fabric of this country.”

Gov. Chris Christie – Wednesday, April 1, 2015
Wall Street Journal:  When asked about the law Wednesday, Mr. Christie said that there should not be “a situation where people perceive that anybody would be denied service.” But he defended Mr. Pence’s character. “I know Mike Pence and he’s got nothing but love in his heart for people,” Mr. Christie said. “I just do not believe that in any way Mike Pence would intend for anything that happened in his state under his watch would be discriminatory toward any person.”  

Center for American Progress says Indiana stands to lose $250 million

Indiana anti homosexuality billToday The Center for American Progress distributed a release, indicating that the state of Indiana now stands to lose at least $250 million for passing their “religious freedom” legislation, which is widely seen as legalizing discrimination against the LGBT community.  Despite the fact the legislation is only a week old, the ‘religious freedom” law has tarnished the state’s reputation and made the state a pariah.  As of April 1st, The Center for American Progress details the lost and at risk revenue as follows:

Lost Revenue:
Angie’s List: $40 million
American Federation of State, County and Municipal Employees, or AFSCME, conference: $500,000

At Risk Revenue:
Big Ten football, 2016–2021: $96 million ($16 million per year)
Big Ten men’s basketball, 2020: $8 million
Big Ten women’s basketball, 2017–2021: $10 million ($2 million per year)
NCAA Men’s Final Four, 2021: $71 million
NCAA Women’s Final Four, 2016: $25 million
Christian Church (Disciples of Christ) 2017 General Assembly: $5.9 million

One should assume this is no joking matter for the state as more companies are now coming out condemning the legislation and indicating their plans to essentially create an embargo on all activity in their state. I think it is safe to say that Governor Pence and the Republican led State legislature in Indiana have done more to harm their state’s reputation and lose more money than they ever expected.  I hope the scrutiny remains and the losses continue to mount.

Mary Bonauto to lead marriage equality argument before SCOTUS

The MacArthur FoundationThe LA Times is reporting that gay rights pioneer, Mary Bonauto, who may be best known as the lawyer who won the first gay-marriage rulings in Massachusetts and Vermont, will lead the argument before the Supreme Court in favor of a constitutional right to same-sex marriage nationwide.  She was selected by the attorneys and the couples from four states whose cases will be heard on April 28.

Bonauto will be representing April DeBoer and Jayne Rowse, two nurses from Michigan who are raising four adopted children. She will argue that the 14th Amendment’s guarantee of liberty and equal protection of the laws requires the state to issue them a marriage license.

Edward M. Kennedy Institute opens Tuesday

Ted KennedyMore than five years has passed since U.S. Senator Ted Kennedy passed away at his home in Cape Cod.  Tomorrow, the Edward M. Kennedy Institute will open next door to the JFK Presidential Library in Dorchester.  The Institute includes a full scale replica of the US Senate chamber – a place Kennedy served for 47 years.

Senator Kennedy’s legacy will hopefully continue through this institute, igniting the imagination and inspiring future generations to embrace civil service and help to build a better community by focusing on those who need help the most; not just those who can afford attorneys and lobbyists.

Buh bye Aaron Schock

SchadenfreudeAlthough Aaron Schock gave his farewell speech to a mostly empty House of Representatives last week, tomorrow is his last day serving in the U.S. Congress. Earlier this month, he announced his resignation after a series of scandals regarding misappropriation of funds and questionable expenses put him in the spotlight.

Rep. Schock is a handsome 30-something bachelor who has been dogged by rumors that he is gay since he started serving in the US Congress in 2009.  I have no idea if that is true, but I would prefer not to believe them because of how terribly he has treated the gay community; supporting (and championing) every anti-LGBT piece of legislation that has come up for a vote.

Some in the media think the gay community and gay bloggers in particular are behaving poorly by gloating at Schock’s misfortune; such as James Kirchick who wrote in the Daily Beast, Hey Gays: Leave Aaron Schock Alone.  To Mr. Kirchick and others who see the LGBT community’s Schadenfreude responses as bitchy, mean or cruel, I say, “Cry me a river”.  Representative Schock has reveled in every setback the gay community has suffered so I’ll be gloating all day tomorrow as he packs up his office and leaves the US Congress.  For Schock’s sake I truly hope he isn’t gay because he’ll not find an ounce of sympathy from me should he come out in the future.  I have only have one thing to say to Mr. Aaron Schock, “Buh-bye“.

Gov Mike Pence from Indiana is lying

Indiana anti homosexuality billThis weekend Indiana’s Governor Mike Pence seemed to be everywhere justifying the “religious freedom” bill he signed into law.  He continually denied that this bill was designed to intentionally discriminate against the LGBT community.

I agree with GLAAD, Governor Mike Pence is a liar. Just because so many Indianans are gullible doesn’t mean everyone else is so naive. #BoycottIndiana

Indiana passes anti-LGBT legislation

discriminationIndiana’s State House earlier today approved the nation’s most anti-LGBT legislation.  According to the IndyStar, similar legislation was passed by the State Senate and Indiana’s Governor has said he intends to sign this into law – all under the guise of protecting religious freedom.  The legislation is modeled on a 22-year old federal law known as the Religious Freedom and Restoration Act. You may recall this act because it was what the US Supreme Court cited in allowing Hobby Lobby to opt out of the Affordable Care Act requirement that they cover contraceptives.

This sort of thing really ticks me off because I get so frustrated having these discussions over and over again. Legally barring a group from a business has haunting parallels to the civil rights struggles from the 1950s and 1960s not to mention more recent legislation organizations like GLAD, HRC and others have overturned in the courts for our community.

Shame on you Indiana – and shame on Indianans.  You may not agree with your state government but this is your home and your home makes me sick.

#RingYourGranny for Marriage Equality

The 1980s Queer activist group Act Up was the first to slap “Silence = Death” stickers all over Boston.  While we’ve thankfully moved beyond those times, the basic premise remains true. LGBT issues become more acceptable when they are openly discussed so I applaud the #RingYourGranny campaign in Ireland.

On May 22nd, Ireland will vote on the Marriage Equality referendum, deciding whether or not same-sex couples can get legally married there.  I’m posting this to voice my support and to ask anyone who might have relatives in Ireland to call them and ask them how they plan to vote.  Sometimes all it takes is the courage to speak up.

 

Barack Obama is America’s first gay president

President ObamaBefore Barack Obama became elected President of the United States, President Bill Clinton was often referred to as America’s first Black President.

The 1998 Nobel laureate Toni Morrison is credited with naming Bill Clinton “the first Black President” in part because of his life story and some parallels to stereotyping and double standards many African Americans face.  Based on those criteria I believe that Barack Obama is America’s first Gay President.

marriage equalityConservatives have hated Obama from his first day in office with fanaticism that defies explanation.  He’s been accused of not being an American citizen, being Muslim (as if that is a pejorative), and according to Mayor Giuliani and many other prominent Republicans – he hates America.  This sort of illogical, blind hatred is something the gay community can relate to.  Our very presence by many conservatives is perceived as an abomination and it would be best if we could be either subjected to reparative “conversion” therapy or removed from society.

Marriage Equality, Same Sex MarriageBarack Obama is the first sitting US President to voice his support for many LGBT issues.  While some Presidents have voiced support for LGBT causes after they left office – Obama has done this while in office and that makes all the difference. Was his decision to voice support for same sex marriage politically motivated?  Probably, but what matters is his actions not his motivations because his support and his words changed minds and hearts.

In addition to what can only be characterized as an unwavering support for marriage equality since 2012, President Obama has worked to help our community more than any other sitting President and possibly more than any Presidents in the near future.  Here are some of his accomplishments:

– Ending the hateful Don’t Ask, Don’t Tell Act (DADT)
– Ending the legal Defense of Marriage Act (DOMA)
– Extending hate crime legislation to include sexual orientation / gender identity
– Federal government recognition of marriage rights for same sex couples even if they live in states that don’t recognize same sex marriage
– Continued support and funding of Ryan White HIV/AIDS programming
– Expanding coverage of health insurance so insurers cannot deny coverage to someone because they are lesbian, gay, bisexual, or transgender
– Taking a stand both with legislation and by making personal “It Gets Better” videos to help prevent bullying and LGBT suicides

While I may disagree with Obama on some things, I will always consider him America’s first gay President.  Obama’s unflinching support for the LGBT community has set a standard which all future Presidential nominees (at least in the Democratic Party) will now be found wanting if they don’t measure up.

#BoycottDolceGabbana

Boycott Dolce Gabbana, #BoycottDolceGabbanaI wasn’t going to comment on the current controversy regarding Stefano Gabbana’s recent comments until he decided to open his mouth again in response to a call for a boycott of D&G products initiated by Sir Elton John and quickly picked up by many others in the gay community.

This is so reminiscent of Guido Barilla’s, Chairman of Barilla Group, comments in 2013.  It begs the question can the Italians join the rest of the world in the 21st century? Who would’ve ever guessed that the current Pope would prove to be a better friend than the founders of D&G?  I’m terribly disappointed in Stefano Gabbana and his one time partner, Dominico Dolce.  Their concept of what a healthy family looks like is terribly flawed and while they have a right to their opinion they clearly don’t understand who their buyers are. Insulting one of your most important group of buyers is an odd way to foster brand loyalty. Somehow I don’t see creeps like Senator Rick Santorum and Senator Ted Cruz buying D&G. Maybe Dolce & Gabbana can team up with Chick-fil-A.

Gov. Baker adds name in pro-gay-marriage brief

Governor Baker, LGBT rightsMassachusetts Governor, Charlie Baker, has become the only sitting Republican Governor to join an amicus brief that will be submitted to the US Supreme Court tomorrow, Friday, March 6th.

The case that the US Supreme Court will hear later this year challenges states’ prohibitions against same-sex marriage on the grounds of the 14th Amendment, the Reconstruction Era measure drafted to provide “equal protection.”

Charlie Baker has a history of supporting LGBT rights, which probably stems from the fact that his younger brother, Alex, is gay.  While I may disagree with Gov. Baker on certain issues, he is a rare breed in the Republican Party; comfortable with the LGBT community and willing to support issues of equality. I would like to see more of his ilk in the Republican party to help mute the Tea Party which seems to have that party by their balls.  I wrote about this exact problem facing the Republican Party in last month’s post, GOP: caught between a rock and a gay place.
